Terms & Conditions

These general Terms and Conditions govern the contractual relationship ("Agreement") between customers (“You”) who use our services to purchase and participate at hikes (“Hike”) through www.stavangeradventure.com (“Site”) and Haaland Hiking, called Stavanger Adventure ("Us/We"), Norwegian organisation number NO 832 127 922.

You must read these Terms and Conditions before booking a Hike. The Agreement is deemed to be concluded once We has accepted a booking You have made in writing via email or by telephone. By booking a Hike, You warrant that You understand, agree to and accept all Terms and Conditions contained at this site.

You agree that Norwegian law applies to the Agreement, as well as all other legal concerns between You and Haaland Hiking.

We reserves the right to make changes to all Terms and Conditions and the Agreement.

1. TERMS OF PAYMENT

Payment for guided Hikes organized by Haaland Hiking is due in advance. All prices are in NOK.

Payments will be made through a secure environment. Haaland Hiking uses a third party service to process Your credit card information and does not store credit card details. Haaland Hiking uses a third party service to process Your Hike booking. ​ When third parties process Your booking and credit card information, Haaland Hiking does not determine the means of collecting and use of any personally identifiable information. Therefore, when third parties process Your booking and credit card information, Haaland Hiking is not acting in the capacity of data controller in terms of the European Union’s Directive 95/46/EC on data privacy or the European Data Protection Regulation (“EU Law”) and does not have the associated responsibilities under EU Law. In these cases, Haaland Hiking should be considered only as a processor on Your behalf. ​Haaland Hiking does not own, control or direct the use of any of Your data stored or processed by third parties necessary to process Your booking and credit card details. Haaland Hiking is largely unaware of what data is actually being stored or made available by a third party, and does not directly access such data, except as necessary to provide Services to You.

2. ALTERATIONS AND CANCELLATIONS BY YOU

You are responsible for providing accurate, timely, and complete information in connection with booking.

Alterations 

includes changes to dates, times, and numbers of participants on confirmed Hikes.

Requests for alterations by You must be submitted by email at least 48 hours before the Hike starts.

​

Cancellations
by You must be made by email at least 48 hours before the Hike starts, and must be acknowledged by Us.

​

No Show
During the booking process, we agree on a pick-up locations, with a pick-up time. If this is other than standard as stated on our web page, this must be requested by You and confirmed by Us. In the event that You are not present and ready to depart at your scheduled pick-up time and location (otherwise known as a ‘no show’), We will call You and wait for 10min and then leave. In such cases, We
 will make no refunds.

You must be reachable by phone at/before Your scheduled pick-up time. We will contact You on the phone number You entered during the booking process. This phone number will also be used by our guide in the event that they cannot locate You for pick-up/meeting.

​

Refunds
for cancelled booked Hikes will be made on the following basis – Cancellation received and acknowledged by Us:

​

  • More than 48 hours before the booked Hike departure: 100% refund*

      *A cancellation fee of 300 NOK per booking applies, to cover administration and transaction costs.

​

  • More than 24 hours before the booked Hike departure: 50% refund

  • Less than 24 hours before the booked Hike departure: no refund

3. ALTERATIONS AND CANCELLATIONS BY US

​

Alterations
Hike program may be altered in unforeseeable circumstances and cases of force majeure, such as – but not limited to – natural catastrophes, social unrest, strikes, the event of government action, road closures, accidents, technical defects, weather conditions, etc. We will do all We can to offer alternative arrangements or another solution in such cases.

​

After the Hike has started – defined by You meeting the guide – any change and/or early turn around / return is considered an alteration, not a cancellation.

​

Alterations in Hike program – prior to and/or during the Hike – by Us does not give You the right to  to claim full or partial refunds and/or compensation.

​

Cancellations
Prior to the Hike start – defined by You meeting the guide – We are entitled to cancel the Hike in cases of:

  • unforeseeable circumstances and cases of force majeure, such as – but not limited to – natural catastrophes, unrest, strikes, the event of government action, road closures, accidents, technical defects, weather conditions, etc.

  • weather conditions in the event that personal-safety can no longer be accounted for.

  • capacity issues.

In case of cancellations by Us, We will offer You the following alternatives:

​

  • A rescheduling / rebooking of the Hike – if possible

  • A full refund of all costs paid

​​

In the event that You show up for a Hike without having the required equipment, as stated in the "Hikes Description", the "Useful Info" on the Site, and/or information sent to You by email prior to the trip, We have the right to cancel the Hike.

In such a case, You agree that no refund will be given by Us.

4. REQUIREMENTS FOR PARTICIPATION

Skills and Level of Physical Fitness

Each Hike offered by Us is labelled with a symbol that indicates the Hike’s level of hiking difficulty, as described in our "Hiking Difficulty" Site.

​

It is important that You do not book Hikes that exceed your skill-level or physical abilities. Based on the information presented on Our website, it is Your responsibility, prior to booking, to determine whether You are physically-fit and skilled enough to safely complete the Hike.

​

During the Hike, if Our guide determines that You are neither skilled nor physically-fit enough to safely complete the Hike, Our guide has the right and duty to turn You around at an early stage. In such a case, You will not be eligible for a refund.

​

Age and size

Each Hike offered by Us has minimum age requirements for participation, which are listed on the respective Hike webpage. It is Your responsibility to make sure all participants in Your party meet or exceed these requirements prior to booking.

​

In the event that any member of Your group fails to meet the Hike’s specific minimum age, We reserves the right to deny the participation of any person who does not meet these requirements. In the event that this occurs, You will not receive a refund.

​

Advance Preparations

Upon completing Your booking, We will send You a email with Hike Information. The email contains important information and instructions regarding the Hike. 

​

In the event that You show up for a Hike without having the required equipment, as stated in the "Hikes Description", the "Useful Info" on the Site, and/or information sent to You by email prior to the trip, We have the right to cancel the Hike.

In such a case, You agree that no refund will be given by Us.

​

Dietary requirements

All Hikes include a warm beverage (cocoa and/or coffee) and chocolate. 

​

Certain hikes offered by Us include meals. Our standard meals, which are based on supplying guests with the calories needed to maintain energy while hiking, may include meat, fish, dairy, and allergens (such as gluten, shellfish, nuts, and yeast).

​

If You  have special dietary requirements, it is Your responsibility to bring Your own food. 

5. RISK AND LIABILITY

You acknowledge that, while all travel involves an element of risk, Hikes offered by Us are adventurous in nature, involve a higher level of personal risk than most activities, and can be potentially hazardous/dangerous/lethal.

​

Risk is always a factor during outdoor Hike activities, especially when weather is unfavorable/unpredictable, or when unforeseen events or conditions create a hazardous situation. There is also an inherent risk involved in joining Hikes that require being exposed to other people. There are many risks, both natural and/or man-made, that could lead to injury or death, including, but not limited to, lightning, flooding, snow/ice, falling trees and/or rocks, landslides, exposure to allergens and/or illnesses, etc.

Bookings confirmed by Us will be allocated suitably qualified guides to meet the client’s requirements. Our guides will be carrying a first-aid kit, water and food supplies, and safety, emergency, navigation, and communication equipment.

​

Prior to joining Our Hikes, it is Your responsibility to familiarize Yourself with the hiking difficulty levels necessary for joining our Hike, as outlined in Our "Hiking Difficulty Level" on the Site.

 

Furthermore, if You or anyone in Your group has concerns related to medical conditions and/or allergies, it is Your responsibility to communicate this to Us prior to joining our Hike. During the Hike, You must assume responsibility for Your own actions, exercise sound judgment, and be prepared for all types of conditions.

Prior to Hike commencement, We will ask You to sign a Liability Release. Signing of the Liability Release is required for joining the Hike.

​

You hereby assume all such risks and You, Your estate, Your family, heirs and assigns hereby release Haaland Hiking and its guides from all claims and causes of action whatsoever arising from any injury, death, or other damages, both pecuniary and non-pecuniary, to You that may occur as a result of Your participation in the Hike offered by Haaland Hiking or as a result of the negligence of any party, including the guide or any employee, officer, agent, contractor or assign of Haaland Hiking, whether such negligence is passive or active.

Under no circumstances will Haaland Hiking be liable to You for any indirect, incidental, consequential, special or exemplary damages arising from any provision of this Agreement or from the provision of any Hike purchased from the Site.

 

Furthermore, the total liability of Haaland Hiking arising with respect to this Agreement and the Site shall in no event exceed the total amounts paid by You to Haaland Hiking under this Agreement.

6. INSURANCE

You are strongly encouraged to obtain suitable medical insurance prior to booking a Hike as well as cancellation insurance.

Cancellations due to guest illness are perceived a risk to be covered by the You, or their travel insurance. Such cancellations do not induce a refund.

You must carry proof of valid travel insurance, covering all registered participants of Your booking and all activities and risks, as well as all geographic regions related to Your Hike with Us for the total duration of the Hike. We may ask to present such proof prior to and during the Hike.

7. PRIVACY

​

Information collection
We collect information from You when you contact us through our contact form, email, phone, SMS, Facebook Messenger, Instagram, or any other way of communication.

​

Information use
In order to make a booking, We need personally identifiable information, like Your name, email address, mobile phone number, and gender. In order to execute Hike`s safely, we need relevant information about Your health and hiking ability.

​

Any of the information we collect from You may further be used in one of the following ways:

  • To operate our customer service (your information helps us to better respond to your questions and individual needs)

  • To improve our website

  • To send periodic emails
    If at any time you would like to unsubcribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

  • To generate general tour and guest statistics, used to improve our services. Statistic results will always be made anonymous before published and/or shared.

Sharing information

(a) Personally identifiable information: We will not rent or sell your personally identifiable information to others. We may store personal information in locations outside the direct control of Haaland Hiking. Any personally identifiable information you elect to make publicly available on our Site, such as posting comments or reviews, will be available to others. If you remove information that you have made public on our Site, copies may remain viewable in cached and archived pages of our Site, or if other users have copied or saved that information.

(b) Non-personally Identifiable Information: We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to help them understand the usage patterns for our website and services. Non-personally identifiable information may be stored indefinitely.

Data protection
We are concerned with protecting your privacy and data, but we cannot ensure or warrant the security of any information you transmit to Us or guarantee that your information may not be accessed, disclosed, altered or destroyed by breach of any of our industry standard physical, technical or managerial safeguards.

Data access
We respect Your privacy rights and provide You with reasonable access to the personally identifiable information that You may have provided through your use of our Site. If You wish to access, update, correct or delete any data We hold about you, or to request that We delete any information about you, please contact Us. At Your request, We will have any reference to You deleted or blocked in Our database.

​

Data storage
We only retain the personally identifiable information collected from You as long as We need it to fulfill the purposes for which We have initially collected it, unless otherwise required by law. We will retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements as follows:

  • Billing information is retained for a period of 7 years.

  • Information on legal transactions between You and Haaland Hiking is retained for a period of 10 years.

 

Data collected by third parties
Except as described in above sections concerning Your privacy, Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested by the customer.

You hereby agree to hold Haaland Hiking harmless for any damages that may result should any personal information about You be released by any third parties. Haaland Hiking is not responsible for the manner in which necessary third parties collect, handles, disclosures, distributes or otherwise processes such information.

8. PHOTOGRAPHS

Photographs captured during the excursion using equipment provided by Us are the exclusive property of Haaland Hiking. We retain the unrestricted right to utilize these images, regardless of You or any other of Your Group are included in them. This includes usage for promotional materials, website content, Instagram, or similar platforms.
